Pollution Legal Liability
The one coverage most haulers skip — and regret.
Pollution legal liability covers cleanup costs, third-party bodily injury, and property damage arising from a release of contaminants — and for a waste hauler, that exposure is constant. A load that leaks onto a highway, contaminated runoff from a tipped container, or discharge at a C&D facility can trigger a pollution claim that a standard general liability policy excludes entirely.

What It Covers
Coverage That Fits How You Actually Operate
Pollution legal liability covers cleanup costs, third-party bodily injury, and property damage arising from a release of contaminants — and for a waste hauler, that exposure is constant. A load that leaks onto a highway, contaminated runoff from a tipped container, or discharge at a C&D facility can trigger a pollution claim that a standard general liability policy excludes entirely.
Even 'clean' construction debris can contain contaminants, and most receiving facilities require proof of pollution coverage before they'll accept your loads. This is the most under-bought coverage in the waste niche — and the one that saves businesses when something leaks.
Leaking load cleanup
Costs to clean up a load that leaks or spills in transit or at a job site.
Contaminated runoff
Third-party claims from contaminated runoff at drop-off and storage sites.
C&D debris discharge
Bodily injury and property damage from contaminants in construction-and-demolition debris.
Landfill leachate exposure
Claims arising from leachate and discharge related to loads you've tipped.
Third-party bodily injury
Illness or injury to third parties from a contaminant release you caused.
Defense and investigation costs
Legal defense, investigation, and remediation expenses — often the bulk of a pollution claim.
Why your GL policy will not cover a pollution claim
Virtually every modern general liability policy contains an absolute pollution exclusion. The moment a load releases a contaminant, the GL carrier invokes the exclusion and walks away — leaving you to fund the cleanup, the third-party claims, and the defense out of pocket. Pollution legal liability is a standalone policy written specifically to fill that gap, and it's priced modestly relative to the catastrophic cost of an uncovered cleanup.
How pollution legal liability is priced
Pollution premiums depend on the materials you haul (household junk is lowest; contaminated soil, liquids, and C&D with suspected contaminants are higher), your annual receipts or tonnage, your storage and handling practices, and the limits you carry. Many haulers add a $1M pollution policy for a few thousand dollars per year — a small cost for the one coverage that prevents a single spill from closing the business.
Common Endorsements & Add-Ons
- Transported cargo coverage. Pollution events arising from materials while in transit on your trucks.
- Non-owned disposal site. Extends coverage to third-party landfills and facilities where you tip loads.
- First-party cleanup. Covers your own cleanup costs for a release on property you occupy.
- Mold and legionella (if applicable). Targeted extensions for haulers handling water-damaged or biologically contaminated material.
Pollution Liability FAQ
Pollution Liability — Your Questions
In most cases, yes. 'Clean' C&D debris can still contain contaminants, and a spill or discharge triggers the pollution exclusion in your GL policy. Many receiving facilities also require proof of pollution coverage before accepting loads. The coverage is inexpensive relative to the cost of an uncovered cleanup.
It covers cleanup costs, third-party bodily injury and property damage, and defense costs from a contaminant release — whether from a leaking load on the highway, contaminated runoff at a job site, or discharge at a landfill. Standard GL excludes all of this.
Many small-to-mid haulers add a $1M pollution policy for roughly $1,500–$4,000 per year, depending on the materials hauled, tonnage, storage practices, and limits. Hauling contaminated soil or liquids costs more; household junk costs less.
